These Terms and Conditions shall govern the relationship between us, namely, JCC PAYMENT SYSTEMS LTD and the Customer and/or User and/or the Merchant, regarding the JCC’s services offered through JCC’s Website.

JCC’s Website is a website which provides in general, all services offered by JCC PAYMENT SYSTEMS LTD to you, the Customer and/or the User and/or the Merchant regarding the transactions between the parties concerned. This Website includes all linked webpages of JCC regarding individual product services offered by JCC.

The use of, and the access to pages of the website is subject to these Terms and Conditions set out below as well as to all other Terms and Conditions pertaining to the individual webpages of particular services of JCC

By accessing, browsing and/or using this Website, you acknowledge that you have carefully read, understood and agree to be bound by these Terms and Conditions as well as all other Terms and Conditions mentioned in the above paragraph, the notices contained herein and to comply with all applicable laws and regulations. Furthermore, you hereby explicitly and unreservedly agree with the content of all the present Terms and Conditions as these may be amended by JCC PAYMENT SYSTEMS LTD from time to time and are available at JCC PAYMENT SYSTEMS’ Website at www.jcc.com.cy. This Website may contain other proprietary notices and copyright information, the terms of which must be observed and followed.

1. DEFINITIONS

1.1.In these Terms and Conditions, unless the context otherwise requires:

“Customer” means a person making use of the Website www.jcc.com.cy and all other websites and/or webpages of JCC.

“JCC” or “us” means JCC PAYMENT SYSTEMS LTD, a company registered in Cyprus, with registration number HE29914 which has its registered office at 1, Stadiou Street, 2571 Industrial Area Nisou, PO Box 21043, 1500 Nicosia, CYPRUS.

“www.jcc.com.cy” means the Website and is the electronic hub of JCC via the internet

Linked Sites” means any links to other websites contained in the Website of JCC.com.cy.

“Merchant” means any entity or individual who has registered with JCC for participation and has a contract with JCC (Agreement for Participation in Card Schemes) under which it accepts Cards from Cardholders in payments for goods and services.

Personal Information” or “Personal Data” means any information relating to an identifiable or identifiable natural person (“data subject”). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

“Terms and Conditions” means these terms and conditions of use as well as all other terms and conditions contained in any other JCC website or webpage as may be amended, extended or replaced from time to time by JCC and notified to the Customer and/or the User and/or the Merchant.

“User” means any person having access to JCC Website or webpages and includes a Customer and/or a Merchant.

Website” means the website named jcc.com.cy and all other websites or webpages of JCC.

1.2. In these Terms and Conditions, references to persons shall include legal entities (unless otherwise specified therein and unless otherwise provided by any applicable law), references to the singular shall include the plural and vice versa and references to any gender shall include all genders.

2. OBLIGATIONS OF JCC AND THE USER

The User shall provide and maintain at his own expense, telephone, personal computer or other equipment necessary to access JCC’s Website and shall ensure that such equipment satisfies all standard technical requirements and/or any other requirements that may be specified by JCC from time to time.

JCC will not be liable for any inaccurate and/or incomplete and/or insufficient information which has been stated/declared by the User through JCC‘s Website in relation to the execution of any transaction. Consequently, JCC will not be liable for any damage and/or loss by the User as a result of such acts.

JCC may at any time and at its absolute discretion extend, suspend or limit the services offered by www.jcc.com.cy and/or decide the hours and days on which www.jcc.com.cy can be accessed.

JCC has the absolute right to approve or reject any application for electronic service.

The User shall be obliged to use www.jcc.com.cy according to the Terms and Conditions. Once the User receives access to www.jcc.com.cy he shall be responsible for the safe-keeping of his account details such as his email address and password and any other log-in details that he may be given by JCC. He shall also be responsible for the prevention of any fraudulent use thereof and should undertake all necessary actions for their safety.

3. INTELLECTUAL PROPERTY RIGHTS

All the information on this Website including all images of JCC is the copyrighted material of JCC except as otherwise indicated. Copying, altering, downloading, republishing, transferring, distributing, broadcasting by electronic or other means or reproducing any of the information on this Website is prohibited without the prior written consent of JCC as this constitutes and remains, at all times, the intellectual property of JCC.

The trade names, marks and logos (or symbols comparable to these) of JCC displayed on or on the Website are the property of JCC. You may not use any of these trade names, marks or logos without advance written permission from JCC.

4. PERSONAL DATA

JCC is committed to the protection, in the highest degree possible, of the Personal Data of the Users of this Website and undertakes to lawfully process these data in accordance with and pursuant to the local applicable law on data protection, including, without limitation, the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) which entered into force on the 25th of May of 2018, as this may be amended and/or replaced from time to time. JCC further undertakes not to disclose the personal data of the Users of this Website unless such disclosure is required by Law or if Users provide their written consent.

The security of your personal information is important to us and this is why we maintain physical, electronic, and procedural safeguards to secure your personal information. JCC Payment Systems Ltd secures the personally identifiable information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure. When personal information such as Card details are transmitted these are protected through the use of encryption such as the Secure Socket Layer (SSL) protocol.

These Terms and Conditions of JCC should be read alongside our Privacy Statement which is also available on the JCC’s website. The Privacy Statement sets out more detailed information about JCC’s use of Personal Information. The Customer and or any User and/or any Merchant should review this Privacy Statement to ensure he understands how JCC processes his Personal Information and understands his rights in respect of it.

5. LINKS TO THIRD PARTY SITES

The Website may contain links to other Linked Sites. The Linked Sites are not under the control of JCC and JCC is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. JCC is not responsible for webcasting or any other form of transmission received from any Linked Site. JCC is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by JCC of the site or any association with its operators.

6. FORCE MAJEURE AND EVENTS BEYOND OUR REASONABLE CONTROL

JCC will not be held responsible for any delay or failure to comply with our obligations under these Terms and Conditions if the delay and/or failure arises from any cause which is beyond our reasonable control, including natural disasters, war or terrorist acts, industrial disputes, strikes, the dropout or non-functioning  of transfer or communications facilities of clearing or settlement organizations, power outages, legislation and regulations from national, foreign and international administrative, civil or judicial authorities. If a case of force majeure arises, JCC will take the actions and measures that are reasonably necessary to limit the negative consequences of such a situation.

7. EXCLUSION OF LIABILITY

THE INFORMATION PROVIDED ON THIS WEBSITE IS BELIEVED TO BE RELIABLE WHEN POSTED. JCC CANNOT GUARANTEE THAT INFORMATION WILL BE ACCURATE, COMPLETE AND CURRENT AT ALL TIMES. IN NO EVENT WILL JCC PAYMENTS SYSTEMS LTD BE LIABLE TO ANY PARTY FOR ANY DIRECT, INDIRECT, SPECIAL OR OTHER CONSEQUENTIAL DAMAGE SUSTAINED BY ANY USER AS A RESULT OF HIS/HER RELIANCE ON INFORMATION CONTAINED IN THIS WEBSITE AND/OR USE OF THIS WEB SITE AND/OR USE OF ANY OTHER LINKED SITE, INCLUDING, WITHOUT LIMITATION, ANY LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF PROGRAMS OR OTHER DATA ON YOUR INFORMATION HANDLING SYSTEM OR OTHERWISE.

8. VARIATION OF THESE TERMS AND CONDITIONS

JCC reserves the right at any time to supplement and/or vary these Terms and Conditions to reflect market conditions, good practices, the services offered, JCC’s policy and system capabilities, relevant laws or for any other reason. The provision of this paragraph may concern amendment of any term of these Terms and Conditions.

JCC may, therefore, at any time revise these Terms and Conditions by updating this posting. By using this Website, you agree to be bound by any such revisions and should therefore periodically visit this page to determine the then current Terms and Conditions to which you are bound.

9. BREACH OF TERMS AND CONDITIONS

In cases of a breach of these Terms and Conditions by any User, JCC may and will take all necessary action to protect its rights. JCC reserves the right, in its sole discretion, to terminate the access to the Website and the related services or any portion thereof at any time, without notice.

10. COMPLAINTS

10.1. Any complaints or enquiries should be addressed to: JCC Payment Systems Ltd, Customer Services, Stadiou 1, 2571 Industrial Area Nisou, PO Box 21043, 1500 Nicosia, Cyprus.

10.2. Where the complaint(s) and/or dispute(s) concerns the goods and/or services purchased by you from a Merchant via the use of JCC, you should settle such disputes with the Merchant.

11. GOVERNING LAW AND JURISDICTION

These Terms and Conditions as well as the use of this Website shall be governed by and construed in accordance with the Laws of the Republic of Cyprus and shall be subject to the jurisdiction of the Cyprus Courts.

Without prejudice to the above subparagraph, JCC shall reserve its rights to bring an action before the Courts of any other country.
